Property buyers obligations

When properties are sold Maple 251’s written consent to the transfer of ownership and membership is required. If you purchase an apartment or house in the Cathedral Walk Development, Darwin Park, Lichfield you will be asked to sign a Deed of Covenant commiting you to observe and perform the covenants contained in your lease or contract. In return the Secretary of Maple 251 will issue a consent to transfer of the property from the existing owner(s) and your admission as a member of Maple (251) Limited . There is a £75 administration charge for dealing with the Deed of Covenant, New Member admission and issue of the Transfer Consent Certificate. In addition new owners are required to make a £25 contribuion to the Maple 251 Emergency Reserve Fund.

PLEASE NOTE:
IF YOU DO NOT OBTAIN MAPLE 251 CONSENT TO YOUR ADMISSION AS A MEMBER AND TRANSFER OF TITLE FOR THE PROPERTY YOU HAVE PURCHASED YOU WILL FORFEIT RIGHTS  OF ACCESS ACROSS THE COMMUNAL LAND TO YOUR PROPERTY.

IF YOU ARE UNABLE TO PROVIDE EVIDENCE OF THE CONSENT TO THE TRANSFER THE LAND REGISTRY WILL NOT REGISTER THE TRANSFER OF TITLE.

Please note also if you are purchasing an apartment your solicitor will also need to contact Cathedral Walk (RTM) Management Company Ltd (the management company responsible for the servicing and maintenance of the apartment blocks) to comply with their transfer arrangments.
